Terms & conditions

General

These standard terms and conditions apply to all contracts entered into by the company unless otherwise stated in the written quotation.

1.0 Definitions

1.1 The company – Komos Events and/or their subcontractors and agents.
1.2 The Hirer – The person/s, company or body hiring equipment from the company.
1.3 The Equipment – All of the equipment provided to, or hired to, the hirer by the company.
1.4 The Hire period – The time commencing immediately after the equipment has been made available for collection, or delivered to and erected on site, and terminating immediately after the equipment has been returned by the hirer or collected by the company.

2.0 Payment

2.1 The hirer will pay a deposit equal to 25% of the hire charge to secure the booking.
2.2 The balance of the full hire charge at the start of the hire period.
2.3 The company reserves the right to charge interested on the full hire charge at bank of England base rate +4% if payment has not been made within 14 days from the hire period.

3.0 Cancellation

3.1 Cancellation must be given in writing 28 days prior to the hire period.
3.2 Cancellation made between 7 and 28 days prior to the hire period will be charged at 50% of the full hire charge.
3.3 Cancellation made less than 7 days from the hire period will be charged at full hire charge.

4.0 The site

4.1 Quotation issued by the company assume that the site is level firm and free of obstructions, with reasonable access for commercial vehicles and that no cables, drains or other services are buried beneath the site or other wise concealed. Any damage resulting there by is the responsibility of the hirer.
4.2 The company shall be granted access to the site for the purpose of erecting and dismantling the equipment as such period the company may require.
4.3 Quotations issued by the company for lighting and power assume that a suitable, sufficient power source is available within 15 meters of the marquee.
4.4 The hire charge includes any reasonable repairs or making good that may be required to the site.

5.0 Hirers Responsibilities

5.1 The Company and the hirer will agree on the positioning and specification of all hired equipment prior to the date of commissioning. The hirer must communicate any changes to the agreed specification at least 7 days before the event.
5.2 The hirer will give notice to or obtain any necessary permits from local authorities and/or site owners prior to erection of the equipment, at the hirer’s expense.
5.3 The hirer or a representative should be present on site during erection of the equipment. If the hirer or representative is not present on site during erection of the equipment, the company will erect the equipment where it sees fit. The hirer will be charged any additional costs incurred should changes in the sitting be required.
5.4 Other than equipment supplied by the company the hirer must not install any electrical, heating or lighting appliances within the marquee structures without obtaining prior consent from the company.
5.5 The hirer shall not tamper with the equipment or any part of the structure and in particular not to affix or suspend from the equipment any item whatsoever without obtaining prior consent from the company.
5.6 The hirer shall keep any part of the equipment that is a framed structure or tent completely closed and secure when not in use.
5.7 The hirer shall heat the interior of the structure to not less than 12oc in the event of snow or should snow be forecast.
5.8 The hirer is responsible for the security of the equipment during the hire period and will be liable for and losses or damage (outside of normal wear and tear). Including any damage caused by the hirer using decorations etc which cause the colour to stain the marquee e.g. “Silly string”.

6.0 Revision of contracts

6.1 The company shall be entitled to revise the contract, by an amount set at the company’s discretion, at any time before the commencement of the hire period, in the event.
6.1.1 That there is a substantial increase in labour or transportation cost.
6.1.3 If strong winds, in excess of force 6, require the company to employ extra staff during erection of the equipment.

7.0 Insurance & Third Party Liability

7.1 The insurance charge covers against fire, theft and damage of equipment but excludes damage by storm or tempest and the first 250-pound of any claim, which is the hirers responsibility.
7.2 The company will not be responsible for, and the hirer will indemnify the company against, all claims for injury to person/s or loss of damage to property however caused, unless proven that such injury or damage resulted from faulty workmanship or materials on the part of the company.

8.0 Force Majeure

8.1 Whilst every effort will be made by the company to complete the order it can not be held responsible for any delays or none completion of orders due to circumstances beyond its control.

9.0 Variation & Governing law

9.1 No variation in these conditions shall be binding on the company unless agreed in writing and signed on behalf of the company.
9.2 In the event of a dispute arising from any agreement entered into, this will be governed under English law.
